Official abstract: Pursuant to the Privacy Act of 1974 and Office of Management and Budget (OMB) Circular No. A-108, notice is hereby given that the Executive Office for Immigration Review (EOIR), a component within the United States Department of Justice (DOJ or Department), proposes to develop a new system of records notice titled "Fraud and Abuse Prevention Program Records," and numbered JUSTICE/EOIR-006. This system of records assists the EOIR Fraud and Abuse Prevention Program (Fraud Program) in receiving, tracking, and managing complaints of suspected immigration fraud, abuse, and unauthorized practice of immigration law, and in referring complaints to Federal, state, and local law enforcement and disciplinary authorities when appropriate. Fraud Program records were previously included within a different system of records, JUSTICE/EOIR-001. See 69 FR 16179 (May 11, 2004). However, JUSTICE/EOIR-001 was recently modified and now only partially covers Fraud Program records. Imposition and Collection of Civil Penalties for Certain Immigration-Related Violations

Official abstract: On June 27, 2025, the Departments issued an interim final rule ("IFR") to streamline assessment of civil penalties under the Immigration and Nationality Act ("INA") for aliens who fail to depart during a voluntary departure period, willfully fail or refuse to depart after a final removal order and certain other proscribed activities, or are apprehended while improperly entering or attempting to enter the United States. This final rule addresses comments and finalizes the IFR with one change: it permits acceptance of a late-filed appeal based on documented mail delivery delays that ICE finds were beyond the alien's control.

Schedules of Controlled Substances: Temporary Placement of 7- Hydroxymitragynine and Mitragynine Pseudoindoxyl Above a Specified Threshold in Schedule I

Official abstract: The Administrator of the Drug Enforcement Administration (DEA) is issuing this notice of intent to publish a temporary order to schedule 7-hydroxymitragynine and mitragynine pseudoindoxyl (including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible) when either substance alone, or their combined amount if both are present, is above a specified threshold, in schedule I of the Controlled Substances Act (CSA). Based on a different threshold provided by the Department of Health and Human Services (HHS) in July of 2025, DEA published a notice of intent to temporarily schedule 7-hydroxymitragynine above that lower threshold on July 7, 2026. Additionally, DEA published a temporary order placing mitragynine pseudoindoxyl without a threshold in schedule I of the CSA on August 26, 2026. On October 8, 2026, HHS sent a letter recommending that DEA place of the CSA 7-hydroxymitragynine and mitragynine pseudoindoxyl in schedule I when either substance alone, or their combined amount if both are present, is above a new specified threshold. Based on the October 8, 2026 letter, DEA is issuing this notice of intent. While the new threshold recommended by HHS would permit certain products to remain in the marketplace without being subject to schedule I controls, neither HHS nor DEA has made a finding that these substances are safe to use at below-threshold levels. When a temporary order is issued, it will impose the regulatory controls and administrative, civil, and criminal sanctions applicable to schedule I controlled substances on persons who handle (manufacture, distribute, reverse distribute, import, export, engage in research, conduct instructional activities or chemical analysis with, or possess) or propose to handle 7- hydroxymitragynine and/or mitragynine pseudoindoxyl above the specified threshold. In a separate document contained in this issue of the Federal Register, DEA is withdrawing the July 7, 2026 notice of intent related to 7-hydroxymitragynine. The August 26, 2026 temporary order placing mitragynine pseudoindoxyl in schedule I of the CSA without a threshold remains in effect until either it expires or the new temporary order is published and the previous order is withdrawn, whichever occurs first.

Schedules of Controlled Substances: Temporary Placement of MGM-15 and MGM-16 in Schedule I

Official abstract: The Drug Enforcement Administration (DEA) is issuing this notice of intent to publish a temporary order to schedule two 7- hydroxymitragynine-related substances (MGM-15 and MGM-16), including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible, in schedule I of the Controlled Substances Act (CSA). On August 26, 2026, DEA published a temporary order placing mitragynine pseudoindoxyl, MGM-15, and MGM-16 in schedule I of the CSA. Today, DEA is providing notice of its intent to publish a new temporary order for MGM-15 and MGM-16 that will maintain the temporary placement of these substances in schedule I of the CSA without change. Separately in this Federal Register, DEA is publishing a notice of intent relating to mitragynine pseudoindoxyl, in response to a letter sent by the Department of Health and Human Services (HHS) dated October 6, 2026. HHS's letter related only to mitragynine pseudoindoxyl. Therefore, DEA is publishing this notice of intent only for the technical and procedural purpose of distinguishing MGM-15 and MGM-16 from mitragynine pseudoindoxyl. When issued, the temporary scheduling order addressing MGM-15 and MGM-16 will continue to impose the regulatory controls and administrative, civil, and criminal sanctions applicable to schedule I controlled substances on persons who handle (manufacture, distribute, reverse distribute, import, export, engage in research, conduct instructional activities or chemical analysis with, or possess) or propose to handle these two 7-hydroxymitragynine-related substances. The August 26, 2026 temporary order placing these substances in schedule I of the CSA remains in effect until either it expires or the new temporary order is published and the previous order is withdrawn, whichever occurs first.

DEA published this temporary order that specifically noted in the summary that the control of O-desmethyltramadol included its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers are possible, however inadvertently omitted the correct language that should have been included. Annual Notices on Explosive Materials Storage Facilities to Local Fire Authority

Official abstract: The Bureau of Alcohol, Tobacco, Firearms, and Explosives ("ATF") is amending Department of Justice ("Department") regulations on reporting explosive materials storage. Currently, any person who stores explosive materials subject to ATF's explosives regulations must notify the authority having jurisdiction for fire safety in that locality when they begin storing explosives at that site. This rule adds a requirement to also submit written notices every 12 months thereafter and when the person ceases storing explosives at that location and to retain copies of the notices for five years. These changes are intended to increase public safety, particularly for first responders.

Implementing the Safe Explosives Act

Official abstract: The Bureau of Alcohol, Tobacco, Firearms, and Explosives ("ATF") is finalizing two Department of Justice ("Department") interim final rules ("IFRs") implementing the Safe Explosives Act. This rule formally ends those rules' interim status, responds to public comments from 2003 on the IFRs, rescinds ATF Ruling 2003-5 issued in response to IFR comments, and makes certain revisions to IFR provisions in response to the comments. They clarify when federal licensees/ permittees must report changes in responsible persons and authorized employees; eliminate verifying identity of persons accepting delivery on behalf of distributees; and amend regulatory exemption language governing aspects of transporting explosive materials.

Revising Requirements and Exceptions for Storing Explosives

Official abstract: The Bureau of Alcohol, Tobacco, Firearms, and Explosives ("ATF") proposes amending Department of Justice regulations listing exceptions to the requirement that explosive materials must be stored in locked magazines. Specifically, ATF proposes adding a testing exception; removing restrictions limiting existing exceptions to materials being physically handled or transported to a site for storing or using; excepting materials to be imminently used or transported; and adopting a perforating gun exception. These changes would streamline on-site operations, acknowledge developments in industry practices, increase safety during these activities by reducing how often explosives are moved, and eliminate the requirement for type 3 magazines.

Explosives Magazine Safety Requirements

Official abstract: The Bureau of Alcohol, Tobacco, Firearms, and Explosives ("ATF") proposes amending Department of Justice ("Department") regulations to streamline requirements for maintaining structures used for storing explosives, called "magazines." ATF proposes consolidating many requirements from four regulatory sections into one, while eliminating other provisions within those sections. The new section would address three topics: safety requirements outside a magazine, inside a magazine, and storing requirements. This proposal would remove unnecessary provisions and examples confusing to the public; update other provisions; and rescind two regulatory sections. The consolidated regulation would also incorporate ATF guidance authorizing alternative methods for storing explosives within containers.
