Hours of Service of Drivers: Association of American Railroads and American Short Line and Regional Railroad Association; Application for Exemption Renewal

Official abstract: FMCSA announces its final decision to renew and modify the exemption granted to the Association of American Railroads and the American Short Line and Regional Railroad Association and member railroads (the Associations) from the hours-of-service (HOS) prohibitions against driving after the 14th hour after coming on duty (the 14-hour rule) and against driving after accumulating 60 hours of on duty time within 7 consecutive days, or 70 hours of on duty time within 8 consecutive days (the 60-hour/70-hour rule). The exemption will enable covered drivers to respond to unplanned events that occur outside of, or extend beyond, their normal work hours. FMCSA modifies the previous exemption to limit the categories of unplanned events during which the exemption may be used and to add reporting requirements. In addition, only drivers operating for motor carriers listed in the Appendix to this decision may operate under the exemption. FMCSA has analyzed the exemption application and has determined that the exemption renewal, subject to the terms and conditions set forth below, is likely to achieve a level of safety that is equivalent to or greater than the level that would be achieved in the absence of the exemption.

The provisional renewal allows Cliffs' employee-drivers with commercial driver's licenses (CDLs) who transport steel coils or scrap metal between the company's production and shipping locations to work up to 16 consecutive hours in a duty period and return to work following at least 8 hours off duty when necessary. The exemption also allows Cliffs to continue using certain specialized coil carrier commercial motor vehicles (CMVs) that do not meet the definition of a "heavy hauler trailer," the requirements concerning the height of rear side marker lamps, tire loading restrictions, and the commodity-specific cargo securement requirements for metal coils. The relief from the requirements of 49 CFR part 393 applies only to Cliffs' specialized coil carrier CMVs; the scrap trucks remain subject to the applicable parts and accessories requirements. Official abstract: FMCSA amends the regulations to revise the requirement that motor carriers and intermodal equipment providers sign and return a completed roadside inspection form to the issuing State agency. FMCSA is aware that not all issuing State agencies require the return of these reports, and that requiring motor carriers and intermodal equipment providers to submit these reports to a State that does not require, or even request, the return of the form creates an unnecessary burden. Through this change, completed forms will only be returned to those States that request them.
