Official abstract: In accordance with the Paperwork Reduction Act of 1995 (PRA), PHMSA invites comments on proposed updates to the form used for reporting incidents that occur during the transportation of hazardous materials. PHMSA intends to request a revision of a currently approved information collection from the Office of Management and Budget (OMB) for the Hazardous Materials Incident Report (DOT Form 5800.1; Form Approval OMB No. 2137-0039). Revisions include new data elements and clarifications of existing fields. PHMSA has also removed, simplified, or reorganized data elements to reduce the burden on filers and staff, alongside modernizing the form's visual layout. PHMSA encourages commenters to review a draft version of the new DOT Form 5800.1, which is provided as a Portable Document Format (PDF) file in the electronic Docket at regulations.gov. This draft of the new form does not replace the currently approved form. It is provided only for purposes of this notice and request for comments.

Hazardous Materials: California's Reusability Mandate for Propane Cylinders

Official abstract: The Federal Hazardous Materials Transportation Act (HMTA), 49 U.S.C. 5101 et seq., preempts California's reusability mandate for propane cylinders in California Public Resources Code, Sections 42395- 42395.2. The reusability mandate imposes localized design and manufacturing requirements on a container that is represented, marked, certified, or sold as qualified for use in the transportation of a hazardous material--specifically, propane--that are not substantively the same as the requirements in the HMR. The reusability mandate is also an obstacle to accomplishing and carrying out the HMTA. By banning a federally authorized, safety-compliant packaging based on localized waste management preferences, California creates a fragmented regulatory patchwork that undermines the primacy and uniformity of the Federal transportation safety framework.

Hazardous Materials: Notice of Administrative Determination of Preemption for Common Law Tort Claims Concerning the Transportation of Gasoline

Official abstract: The Exxon Mobil Corporation (Exxon) seeks a determination that Federal law preempts State common law claims brought against it in New Jersey concerning the safe transportation of gasoline in commerce. PHMSA is issuing a final administrative determination concluding that the State common law tort claims presented by Exxon are preempted. Each of these duties, if imposed, would present an obstacle to compliance with the Federal regulatory framework essential for the safe transportation of gasoline. In addition, any claims about covered subjects, such as the marking, loading and unloading, and classification of gasoline that are not substantively the same as the applicable HMR provisions are preempted.

Pipeline Safety: Repair Criteria for Hazardous Liquid and Gas Transmission Pipelines

Official abstract: PHMSA proposes to modernize and to clarify the anomaly response criteria in the Federal pipeline safety regulations for gas transmission and hazardous liquid pipelines. Driven by twenty years of technological development, modern engineering concepts allow operators to identify, schedule, and remediate pipeline anomalies more effectively and in a less costly manner. PHMSA proposes incorporating these improved safety practices into its regulations by finalizing certain safety improvements advanced in recent rulemakings for gas transmission pipelines and extending those changes to hazardous liquid pipelines. In addition, PHMSA proposes certain non-substantive revisions to its gas and hazardous liquid repair regulations to improve compliance.

Pipeline Safety: Breakout Tank Inspection Rule

Official abstract: Breakout tanks are used to "relieve surges in a hazardous liquid pipeline system" or to "receive and store hazardous liquid transported by a pipeline for reinjection and continued transportation by pipeline." American Petroleum Institute Standard 653 (API Std 653) sets industry standards for the inspection, repair, alteration, and reconstruction of aboveground storage tanks. PHMSA currently incorporates the 3rd edition of API Std 653 (issued December 2001) by reference into its regulations for breakout tanks. In this rulemaking, PHMSA is proposing to update its regulations for breakout tanks to incorporate the 5th edition of API Std 653 (issued November 2014) by reference. Pipeline Safety: Class Location Change Requirements; Correction

Official abstract: PHMSA is making a technical correction to a January 14, 2026 final rule that amended the class location change requirements. The final rule allows an operator to confirm or to restore the maximum allowable operating pressure (MAOP) of an eligible gas transmission pipeline segment that experiences a class location change by implementing an integrity management (IM) alternative. For MAOP restorations, PHMSA is clarifying in this correction notice that the 24-month deadline for implementing the initial programmatic requirements of the IM alternative runs from the effective date of the final rule or the date that an operator decides to initiate an MAOP restoration, whichever is later. This clarification is consistent with the requirements in the final rule, including the deadline in the IM alternative that applies to MAOP confirmations, which runs from the effective date of the final rule or the date of the class location change, whichever is later.
