Marine Mammals; Incidental Take of Polar Bears and Pacific Walruses in the Beaufort Sea and North Slope of Alaska
Official abstract: We, the U.S. Fish and Wildlife Service (FWS), in response to a request under the Marine Mammal Protection Act (MMPA) of 1972 from the Alaska Oil and Gas Association (AOGA), finalize regulations facilitating the authorization of incidental, unintentional take of small numbers of polar bears (Ursus maritimus) and Pacific walruses (Odobenus rosmarus divergens) during year-round oil and gas industry activities in the Beaufort Sea (Alaska and the Outer Continental Shelf (OCS)) and adjacent northern coast of Alaska. Take may result from oil and gas exploration, development, production, and transportation activities occurring for a period of 5 years. Oil and gas industry operations include similar types of activities covered by the previous 5-year Beaufort Sea incidental take regulations effective from August 6, 2021, through August 5, 2026. General Provisions; Revised List of Birds Protected by the Migratory Bird Treaty Act
Official abstract: We, the U.S. Fish and Wildlife Service (Service), propose to revise the List of Birds Protected by the Migratory Bird Treaty Act (MBTA) by both adding and removing species and changing names to conform to accepted use by the scientific community. Reasons for the proposed changes to the list include adding species based on new taxonomy and new evidence of natural occurrence in the United States or U.S. territories, removing species no longer known to occur within the United States or U.S. territories, and changing names to reflect currently accepted taxonomy and nomenclature. The net increase of 25 species (32 added and 7 removed) would bring the total number of species protected by the MBTA to 1,131. We also propose to revise the names of species subject to specific migratory bird permit regulations to reflect currently accepted taxonomy and nomenclature. We are taking this proposed action because an accurate and up-to-date list of species protected by the MBTA is essential for public notification, regulatory, and law-enforcement purposes, and to ensure consistency in the use of common and scientific names across Service regulations.

Process for Authorizing Seasonal Migratory Game Bird Hunting
Official abstract: The U.S. Fish and Wildlife Service (Service or we) is changing the administrative process for authorizing seasonal migratory game bird hunting in the United States. Migratory game bird hunting regulations are currently promulgated annually to provide opportunities for recreation and sustenance; aid Federal, State, and Tribal governments in the management of migratory game birds; and allow harvests at levels compatible with migratory game bird population status and habitat conditions. The Service is adopting a more efficient administrative process for authorizing seasonal migratory game bird hunting. The Service will issue a memorandum to establish the limits and authorize seasonal migratory game bird hunting once every 3 years. The Service will continue to make annual decisions on harvest levels and will update the memorandum sooner than 3 years if changes are prescribed by our decision frameworks. The process eliminates the need for subsequent annual Federal regulation promulgation and rulemaking and is expected to increase efficiency; better meet State, Tribal, and Federal rulemaking constraints; and reduce the complexity and costs. Our goal is to better serve State partners and the hunting public while continuing to meet the legal and conservation purposes of the Migratory Bird Treaty Act. Tribes are already authorized under a similar process.

Authorization Conditions and State Seasons for Seasonal Migratory Game Bird Hunting
Official abstract: The U.S. Fish and Wildlife Service (Service or we) announces the availability of the 2026 Migratory Game Bird Hunting (MGBH) Memorandum setting forth the authorization conditions (conditions or limits) within which States and Tribes may establish their hunting regulations for certain migratory game birds. The conditions include species for which seasons may be opened, season dates, season lengths, shooting hours, bag and possession limits, areas where migratory game bird hunting may occur, and other restrictions. The conditions are necessary to allow States and Tribes to establish their migratory game bird hunting regulations and to allow harvest at levels compatible with migratory game bird population status and habitat conditions. Migratory game bird hunting seasons provide opportunities for recreation and sustenance, and aid Federal, State, and Tribal governments in the management of migratory game birds. We are also announcing the availability of the 2026 memorandum with seasons, hours, areas, and daily bag and possession limits for migratory game bird hunting in certain States that requested we publish these. Taking of migratory birds is prohibited unless specifically provided for in this memorandum and other applicable State and Federal regulations.

Endangered and Threatened Wildlife and Plants; 90-Day Findings for 10 Species
Official abstract: We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on 10 petitions to add species to the Lists of Endangered and Threatened Wildlife and Plants under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that the petitions to list the Cascade red fox (Vulpes vulpes cascadensis), diamondback terrapin (Malaclemys terrapin), Goose Lake lamprey (Entosphenus tridentatus ssp.), Goose Lake sucker (Catostomus occidentalis lacusanserinus), Goose Lake tui chub (Siphateles thalassinus thalassinus), loopy five firefly (Photuris forresti), and plains spotted skunk (Spilogale interrupta) present substantial scientific or commercial information indicating that the petitioned actions may be warranted. Therefore, with the publication of this document, we announce that we are initiating status reviews of these seven species to determine whether the petitioned actions are warranted. To ensure that the status reviews are comprehensive, we request scientific and commercial data and other information regarding the species and factors that may affect their status. Based on the status reviews, we will issue 12-month petition findings, which will address whether or not the petitioned actions are warranted, in accordance with the Act. We further find that the petitions to list the Ellett Valley millipede (Pseudotremia cavernarum), long-tailed macaque (Macaca fascicularis), and Louisiana black bear (Ursus americanus luteolus) do not present substantial scientific or commercial information indicating the petitioned actions may be warranted. Therefore, we are not initiating status reviews for these three species.

Process for Authorizing Seasonal Migratory Game Bird Hunting
Official abstract: The U.S. Fish and Wildlife Service (Service or we) is proposing changes to the administrative process for authorizing seasonal migratory game bird hunting in the United States. Migratory game bird hunting regulations are currently promulgated annually to provide opportunities for recreation and sustenance; aid Federal, State, and Tribal governments in the management of migratory game birds; and allow harvests at levels compatible with migratory game bird population status and habitat conditions. The Service proposes a more efficient administrative process for authorizing seasonal migratory game bird hunting. The Service would issue a memorandum for migratory game bird hunting once every 3 years. The Service would continue to make annual decisions on harvest levels and would update the memorandum sooner than 3 years if changes are prescribed by our decision frameworks.
