Wyoming Regulatory Program

Official abstract: The Office of Surface Mining Reclamation and Enforcement (OSM), are approving an amendment to the Wyoming regulatory program (Wyoming program) under the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act). The Wyoming Land Quality Division (WLQD) submitted this proposed amendment in response to our January 19, 2024 partial approval of an amendment to WLQD's regulations for coal exploration by drilling (SATS No. WY-050-FOR; Docket ID No. OSM-2021- 0004). In the final rule, under the heading "Revisions to Wyoming's Rules That We Are Not Approving," OSM listed several provisions containing typographical errors that WLQD would need to correct through future rulemaking. WLQD now proposes those corrections with this amendment (SATS No. WY-055-FOR; Docket ID No. OSM-2025-0002).

Alaska; Wildlife, Harvest, and Access

Official abstract: The National Park Service (NPS) amends its regulations for hunting, fishing, trapping, and other harvest-related activities in Alaska and the procedures used to restrict public use and access in Alaska park areas, including for subsistence. This rule restores the regulatory framework adopted to implement the Alaska National Interest Lands Conservation Act of 1980 (ANILCA) in 1981 that guided management for more than three decades, with targeted updates to that framework in response to public comments and further agency review. The restored framework recognizes the complementary and distinct roles of the State of Alaska, the Federal Subsistence Management Program, and the NPS in managing public uses and resources in Alaska park areas. The rule removes regulatory changes made in 2015, 2017, and 2024 that departed from that framework. These amendments are consistent with Executive Orders 14153 and 14192 and Secretary of the Interior's Orders 3422 and 3447.

Denali National Park and Preserve; Vehicle Use

Official abstract: The National Park Service (NPS) amends special regulations for Denali National Park and Preserve to conform the regulations regarding the number of vehicles that can travel on the restricted section of the Denali Park Road (miles 15-90) to a Vehicle Management Plan that the NPS has been implementing since 2012. This rule implements the plan's limit that no more than 160 vehicles may travel on the restricted section of the road per 24-hour period during the visitor season (also referred to as the "allocation season"), defined in the park's General Management Plan as beginning on the Saturday before Memorial Day and ending on the second Thursday after Labor Day. This limit allows the NPS to meet growing visitor demand while maintaining a high- quality experience for visitors.

Big Cypress National Preserve; Off-Road Motor Vehicles

Official abstract: The National Park Service proposes to amend special regulations for Big Cypress National Preserve that regulate the use of motorized vehicles off roads. The current regulations refer to a map that identifies areas within the National Preserve where motorized vehicles can be used unless closed by the Superintendent. This map is outdated and does not depict the current boundary of the National Preserve, which was expanded in 1988 by approximately 147,000 acres. This rule would replace references to the outdated map with references to a map showing the current boundary of the National Preserve, with the effect of expanding the areas within the National Preserve where motorized vehicle use could occur, subject to the discretion of the Superintendent.

General Provisions; Revised List of Birds Protected by the Migratory Bird Treaty Act

Official abstract: We, the U.S. Fish and Wildlife Service (Service), propose to revise the List of Birds Protected by the Migratory Bird Treaty Act (MBTA) by both adding and removing species and changing names to conform to accepted use by the scientific community. Reasons for the proposed changes to the list include adding species based on new taxonomy and new evidence of natural occurrence in the United States or U.S. territories, removing species no longer known to occur within the United States or U.S. territories, and changing names to reflect currently accepted taxonomy and nomenclature. The net increase of 25 species (32 added and 7 removed) would bring the total number of species protected by the MBTA to 1,131. We also propose to revise the names of species subject to specific migratory bird permit regulations to reflect currently accepted taxonomy and nomenclature. We are taking this proposed action because an accurate and up-to-date list of species protected by the MBTA is essential for public notification, regulatory, and law-enforcement purposes, and to ensure consistency in the use of common and scientific names across Service regulations.
